These Terms of Service (“Terms”) govern your use of LUXE CLUB MANILA and all services provided through luxeclubmanila.com. Please read them carefully before using the platform.

1. Acceptance of Terms

By accessing or using LUXE CLUB MANILA at luxeclubmanila.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

These Terms apply to all visitors, users, VIP members, and partners. LUXE CLUB MANILA reserves the right to update these Terms at any time. Continued use of the platform following any changes constitutes acceptance of the revised Terms.

2. Platform Description

LUXE CLUB MANILA is an AI-powered luxury curation and concierge platform serving Metro Manila, Philippines. The platform provides:

Venue Discovery: Curated listings of premium restaurants, bars, clubs, wellness facilities, and professional services across BGC, Makati, Rockwell, Malate and surrounding districts.
AI Concierge (Sofia AI): An AI-powered assistant that helps users find and book premium experiences based on stated preferences.
Editorial Content: Original articles, guides, and reviews produced by the LUXE CLUB MANILA editorial team.
VIP Membership: A tiered membership programme offering priority reservations, exclusive access, and dedicated concierge services.
Partner Programme: A commercial listing and promotion service for premium venue operators.

3. User Obligations

By using LUXE CLUB MANILA, you agree to:

Accurate Information: Provide accurate, current and complete information when creating a profile, submitting forms, or making concierge requests.
Lawful Use: Use the platform only for lawful purposes. You may not use LUXE CLUB MANILA to facilitate illegal activities, fraud, or harassment.
Respect for Venues: Honor reservations made through LUXE CLUB MANILA. Repeated no-shows or abuse of concierge services may result in suspension of access.
No Scraping: You may not scrape, copy, or systematically extract content from LUXE CLUB MANILA without our written consent.
Age Requirement: By using LUXE CLUB MANILA, you confirm you are at least 18 years of age. The platform includes content related to alcoholic beverages and nightlife.

4. Concierge Services & Bookings

Nature of Service: LUXE CLUB MANILA acts as an intermediary between users and partner venues. We facilitate reservations but are not a party to the contract between user and venue.
Availability: Reservations are subject to venue availability. LUXE CLUB MANILA does not guarantee availability at any specific venue or time.
Concierge Fees: For Platinum and Black Label members, concierge arrangement fees may apply. These are disclosed prior to confirmation and are non-refundable after the venue has confirmed the booking.
Cancellations: Cancellations must be made before venue confirmation to receive a full refund of concierge fees. After venue confirmation, cancellation policies are governed by the venue's own terms.
Liability: LUXE CLUB MANILA is not liable for the quality of service, food, or experience delivered by partner venues. Any disputes regarding venue services should be directed to the venue.

5. VIP Membership

Billing: Platinum (₱2,500/month) and Black Label (₱8,000/month) memberships are billed monthly. You may cancel at any time, but refunds are not issued for the current billing period.
Black Label Eligibility: Black Label membership is by invitation or application approval. LUXE CLUB MANILA reserves the right to accept or decline any application without providing a reason.
Termination: LUXE CLUB MANILA may terminate or suspend any membership account for violation of these Terms, abuse of concierge services, or behaviour that negatively impacts other members or partner venues.
Benefit Changes: We reserve the right to modify membership benefits with 30 days' notice. If benefits are materially reduced, members may cancel without penalty.

6. Content & Intellectual Property

LUXE CLUB MANILA Content: All editorial articles, AI-generated recommendations, brand assets, and platform design are the intellectual property of LUXE CLUB MANILA. You may not reproduce, distribute, or commercially exploit this content without written permission.
User Content: Any content you submit (reviews, comments, form responses) grants LUXE CLUB MANILA a non-exclusive licence to use this content to improve the platform and editorial quality.
Venue Data: Venue information sourced from Google Places API is subject to Google's terms of service. LUXE CLUB MANILA editorial descriptions are original and protected by copyright.

7. Disclaimers & Limitation of Liability

No Warranties: LUXE CLUB MANILA is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of security vulnerabilities.
Venue Accuracy: While we strive to maintain accurate venue information, LUXE CLUB MANILA does not guarantee the accuracy, completeness, or timeliness of listings. Always verify critical details (hours, pricing, dress codes) directly with venues.
AI Limitations: Sofia AI's recommendations are generated by machine learning models and may occasionally be inaccurate or incomplete. Do not rely solely on AI recommendations for critical decisions.
Liability Cap: To the maximum extent permitted by Philippine law, LUXE CLUB MANILA's total liability to any user shall not exceed the amount paid by that user to LUXE CLUB MANILA in the 12 months preceding the claim.

8. Governing Law & Contact

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from use of LUXE CLUB MANILA shall be subject to the exclusive jurisdiction of the courts of Taguig City, Metro Manila.
